What Are Surplus Funds?

Surplus funds — also known as excess proceeds, overages, or surplus proceeds — are created when a property is sold at a tax sale or foreclosure auction for more than the amount owed.

Here's how it happens: when a property is auctioned to satisfy delinquent taxes or a defaulted mortgage, bidders compete, and the winning bid often exceeds the total debt — the delinquent taxes or loan balance, plus penalties, interest, and fees. That extra money left over after every debt is paid is the surplus.

And here's what most people never find out: that money legally belongs to the former property owner.

Not the county. Not the bank. Not the investor who bought the property at auction. If you lost a home to a tax sale or foreclosure, the surplus is yours by law.
